  • Grant or arrange safe access to the subject property for site visits, surveys, and assessments as required.

  • Pay all Local Planning Authority (LPA) application fees, specialist third-party consultant fees (e.g., ecology, transport, heritage, flood risk), and statutory charges directly to the relevant bodies.

  • Review draft documentation, plans, and planning statements promptly to prevent project delays.

6. Fees, Statutory Charges & Payment Terms

  1. Professional Fees: Our fees will be specified in the formal Fee Proposal on a fixed-fee, hourly rate, or phased milestone basis.

  2. LPA & Third-Party Charges: Our fee quotes exclude statutory council submission fees, building control fees, and specialist sub-consultant costs unless explicitly stated otherwise in writing.

  3. Payment Terms: Invoices are payable within 14 days of issue unless alternative milestones are agreed upon in writing. We reserve the right to withhold the formal submission of planning applications to the LPA until relevant interim or deposit invoices are settled in full.

  4. Late Payment Interest: Late payments may incur statutory interest in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 at 8% above the Bank of England base rate.

7. Limitation of Liability & Insurance

  1. Professional Insurance: DN Planning Services maintains Professional Indemnity Insurance appropriate to the scale of our consultancy operations.

  2. Financial Cap: To the maximum extent permitted by applicable law, our aggregate financial liability to the Client for any loss, damage, claims, or costs arising out of or in connection with our Services shall be strictly limited to the total professional fees paid by the Client to us under the specific engagement.

  3. Indirect Loss: We shall not be liable for any indirect, economic, or consequential losses, including loss of profit, loss of land value, development delays, or third-party construction costs.

  4. Statutory Carve-out: Nothing in these Terms limits or excludes liability for death or personal injury resulting from negligence, or for fraud or fraudulent misrepresentation.

8. Cancellation & Termination

  1. Client Cancellation: The Client may terminate the engagement at any time by giving written notice. Upon termination, the Client remains liable for all work completed and expenses incurred up to the date of cancellation.

  2. Consumer Cancellation Rights: Where the Client is a consumer (acting outside a trade/business) entering into a contract online or off-premises, rights under the Consumer Contracts Regulations 2013 apply, granting a 14-day cancellation window unless the Client expressly requests immediate commencement of services.

  3. Consultant Termination: We reserve the right to suspend or terminate services immediately if a conflict of interest arises, if fees remain unpaid, or if the Client fails to provide necessary instruction or cooperation.

9. Data Protection & Privacy

We handle all personal data in compliance with the UK GDPR and Data Protection Act 2018. Details regarding how we collect, process, store, and share data (including required submissions to public planning registers) are outlined in full in our Privacy Policy.

10. Third-Party Links & External Services
